The legal agreement governing your use of TruScript's digital healthcare trust platform.

Acceptance of Terms

By accessing or using TruScript ("the Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use the Platform. These terms apply to all users, including practitioners, patients, employers, and authorised verifiers.

1. Definitions

"Platform"

TruScript's web-based software, APIs, and associated services for issuing and verifying medical certificates.

"Practitioner"

A registered healthcare professional authorised to issue medical certificates through the Platform.

"Certificate"

A digitally signed, verifiable medical certificate issued through the Platform.

"User"

Any individual or entity that accesses or uses the Platform, including patients, practitioners, employers, and verifiers.

2. Eligibility & Accounts

  • •You must be at least 18 years old to create an account
  • •Practitioners must hold valid registration with the HPCSA or equivalent body
  • •Organisations must provide valid registration and billing information
  • •You are responsible for maintaining the confidentiality of your account credentials
  • •One account per person; sharing accounts is prohibited
  • •Accounts may be suspended or terminated for violations of these terms

3. Acceptable Use Policy

✓ Permitted Uses

  • • Issuing medically accurate certificates for genuine consultations
  • • Verifying certificates issued by registered practitioners
  • • Maintaining accurate patient records and clinical documentation
  • • Using the Platform in compliance with healthcare regulations

✗ Prohibited Uses

  • • Issuing fraudulent or false medical certificates
  • • Unauthorised access to another user's data
  • • Reverse-engineering or exploiting the Platform
  • • Using the Platform for illegal activities

4. Certificate Accuracy & Liability

Practitioner Responsibility: Practitioners are solely responsible for the medical accuracy and clinical justification of every certificate issued. TruScript provides the technical infrastructure but does not validate clinical decisions.

Verifier Responsibility: Verifiers must independently confirm the authenticity of certificates through official verification channels before acting on them.

Platform Liability: TruScript shall not be liable for any damages arising from inaccurate certificates, provided the system functioned as designed and all security protocols were followed.

5. Intellectual Property

  • • The Platform, including all code, design, and branding, is the intellectual property of TruScript
  • • Users retain ownership of the clinical content they create within the Platform
  • • Digitally signed certificates may be used by patients for verification purposes as intended
  • • Reproduction of the Platform's technology or branding without written consent is prohibited

6. Privacy & Data Protection

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection and use of information as described therein, in compliance with POPIA.

All medical data is treated with the highest level of confidentiality and is protected by enterprise-grade encryption and access controls.

7. Subscription & Payment Terms

  • • Subscription fees are billed in advance on a monthly or annual basis
  • • All fees are non-refundable except as required by law
  • • Prices may change with 30 days' notice to existing subscribers
  • • Failure to pay may result in service suspension after 14 days
  • • Organisation subscriptions are non-transferable between entities

8. Termination & Suspension

  • • You may terminate your account at any time through account settings
  • • TruScript may suspend or terminate accounts for violations of these terms
  • • Upon termination, your right to use the Platform ceases immediately
  • • Issued certificates remain valid and verifiable for regulatory compliance periods
  • • Audit logs are retained indefinitely per regulatory requirements

9. Disclaimers & Limitation of Liability

No Warranty: The Platform is provided "as is" without warranties of any kind, either express or implied, including but not limited to fitness for a particular purpose.

Limitation of Liability: In no event shall TruScript be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

Force Majeure: TruScript shall not be liable for any failure to perform due to circumstances beyond its reasonable control.

10. Governing Law & Dispute Resolution

  • • These terms are governed by the laws of the Republic of South Africa
  • • Any disputes shall be resolved in the courts of Cape Town, South Africa
  • • We encourage users to contact support before initiating legal proceedings
  • • Regulatory compliance matters are subject to South African healthcare law

11. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated through the Platform or via email. Continued use of the Platform after changes constitutes acceptance of the modified terms.
